Terms of Service

These Terms of Service ("Terms") govern your use of the Galore De Teddies website and services operated by Galore De Teddies ("we", "us", "our"), a South African business. By accessing or using our platform you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or placing an order you confirm that you are at least 18 years old (or have parental consent if younger) and that you accept these Terms in full. If you do not agree, please do not use our services.

2. Our Services

Galore De Teddies operates four distinct service models:

• Custom Teddy Program: Customers submit drawings that our community creators handcraft into unique crochet teddy bears.
• Marketplace: Independent sellers list their own handcrafted crochet creations for sale on our platform.
• Creator Program: Community crafters (grannies, moms, makers) produce custom teddies and earn flat pay per completion.
• Affiliate Program: Affiliates promote our products and earn commission on sales driven through their unique links.
• Teddy Creator Club: Children's designs are listed in the shop with parental consent, earning royalties on each resale.

3. User Accounts

• You must provide accurate information when registering. One account per person.
• You are responsible for maintaining the security of your account credentials.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Custom Orders

• By submitting a drawing you grant us a licence to reproduce it as a physical crochet item.
• Once production has commenced, custom orders cannot be cancelled or refunded unless the item is faulty or significantly different from the approved design.
• We reserve the right to decline designs that are offensive, infringe third-party IP, or are not feasibly producible.
• Production time is typically 10 to 21 business days. Shipping is additional and paid by the customer.

5. Marketplace Sellers

• A commission of 48-58% of the sale price is given to the seller this is what is left after platform fees, Affiliate commisions and shipping cost that my vary.
• Sellers must list only handcrafted items that meet our quality and safety standards.
• Prohibited: mass-produced goods, offensive content, items that infringe intellectual property.
• Payouts are processed monthly via EFT to a valid South African bank account.
• Sellers are responsible for their own tax obligations on income earned.

6. Creator Program

• Creators earn a flat payment of 40% per completed teddy this is what is left after platform fees, Affiliate commisions and shipping cost that my vary
• Creators may not negotiate prices with customers directly. All pricing is set by Galore De Teddies.
• We reserve the right to reassign an order if quality standards are not met or a deadline is missed.

7. Affiliate Program

• Affiliates earn 5% commission on qualifying sales attributed to their unique referral link.
• Attribution window is 30 days from first click.
• Prohibited: spam, misleading advertising, paid search bidding on our brand name, or any deceptive promotion.
• Commissions are paid monthly once a minimum threshold of R100 is reached.

8. Teddy Creator Club

• A parent or legal guardian must provide explicit consent before a child's design is listed in the shop.
• The child creator receives a royalty of 15% of the sale price.
• By consenting to list a design you grant Galore De Teddies a non-exclusive licence to reproduce and sell the design. The child retains ownership of the original drawing.
• We reserve the right to approve or decline designs based on production feasibility and community standards.
• Royalties are paid to the parent's or guardian's registered account. Minors cannot receive payments directly.

9. Intellectual Property

• Our logo, website design, and platform code are the intellectual property of Galore De Teddies. You may not reproduce them without permission.
• Customer drawings submitted for custom orders remain the intellectual property of the customer. The platform licence granted is limited to production and sale of the physical teddy.

10. Privacy and Data Protection

We process your personal information in accordance with South Africa's POPIA. See our Privacy Policy and POPI Act Compliance pages for full details.

11. Governing Law

These Terms are governed by the laws of South Africa. Any disputes will be subject to the jurisdiction of the courts of South Africa, with Western Cape as the preferred venue.
